A public officer whose function is to attest and certify, by his hand and official seal, certain classes of documents, in order to give them credit and authenticity in foreign jurisdictions; to take acknowledgments of deeds and other conveyances, and certify the same; and to perform certain official acts, chiefly in commercial matters, such as the protesting of notes and bills, the noting of foreign drafts, and marine protests in cases of loss or damage. A return sometimes made by sheriffs or constables to a writ of execution; but it is not a technical formula, and is condemned by the courts as ambigu- ous and insufficient. See Martin v. When the amount available in the drawer’s account is less than the amount stated on the check, the bank reserves the right to return the check to the depositor. When this occurs, the depositor is expected to pay a penalty to the bank. If this occurs frequently, the bank reserves the rightto unilaterally close the holder’s account. It is considered a crime in some locations, to issue a check that will be returned.
